Fox News thrives two years after court settlement, but 2020 election coverage fight goes on - ABC News

The conservative network Newsmax's $67 million settlement with Dominion Voting Systems over false claims after the 2020 election recalled Fox's own $787.5 million deal with the same company more than two years ago. Yet, it's hard to understate the worry many at Fox had about losing audience immediately following the 2020 election. Trump, and many of his fans, were angry that the network declared Biden the winner in Arizona before most news outlets, a pivotal moment in the vote-counting.Newsmax said Fox has tried to block television distributors from carrying its rival, hired private detectives to investigate Newsmax executives and pressured guests not to appear on the network. In response, Fox said, “Newsmax cannot sue their way out of their own competitive failures in the marketplace to chase headlines simply because they can't attract viewers.” · Smartmatic said Fox has never retracted, or apologized for, programs that falsely suggested the company was involved in changing votes in 2020.The network settled a lawsuit with Smartmatic in 2024. In a statement aired on Newsmax in December 2020, the network said that “no evidence has been offered that Dominion or Smartmatic used software or reprogrammed software that manipulated votes in the 2020 election.” The following April, Newsmax apologized for airing false allegations that a Dominion employee, Eric Coomer, manipulated voting machines or tallies to the detriment of Trump in 2020.The network said on the air: “Newsmax believed it was critically important for the American people to hear both sides of the election disputes that arose in 2020.

The right-wing network complained that Davis’ pretrial rulings “limited Newsmax’s ability to defend itself.” Among Newsmax’s gripes was a key finding from Davis that it was false for anyone on Newsmax to claim that the 2020 election was rigged — a pivotal boost for Dominion that was consistent with how he ruled in the related Fox-Dominion lawsuit.Newsmax maintains that it never defamed Dominion, and reiterated Monday that it believes its 2020 election coverage followed “accepted journalistic standards.” The network has repeatedly pointed out that it broadcasted a “clarification” segment in December 2020, saying it didn’t have evidence that Dominion manipulated any votes.Egregious lies about the 2020 presidential election are going to cost Newsmax millions. There was no indication that Newsmax will offer any on-air apology or acknowledgment of its false claims about Dominion, a voting hardware and software company that became the target of many pro-Trump conspiracy theories about the 2020 presidential election.

New details reveal Fox News’ risks and rewards for covering Trump’s 2020 election claims

Filings in Smartmatic's lawsuit against the network show that the channel’s “pivot” after the 2020 election was just a taste of what’s to come. Hundreds of pages of damning filings in Smartmatic’s $2.7 billion lawsuit against Fox, in which the election technology company alleges it was defamed on Fox News' airwaves after the 2020 election, became newly available to the public this week after the court removed substantial redactions to the documents. The unveiling came two years after the right-wing network paid a record $787.5 million to settle a similar lawsuit with Dominion Voting Systems. The Smartmatic filings, like those from Dominion’s suit, are stuffed with internal Fox text messages, emails and other communications that paint a vivid picture of operations within the network in late 2020.While some have left the network over the past year, they did so to join Trump’s second administration. Meanwhile, those depicted as trying to stand up for facts were largely purged. With hindsight, it’s easy to see that since airing deceit after the 2020 election, Fox has solidified an incentive structure in which staffers are rewarded for propping up Trump and everything he does, while they risk consequences only for breaking with that edict.Host Jesse Watters, in a text message to fellow "The Five" co-host Greg Gutfeld revealed in the filings, wrote: “Think about how incredible our ratings would be if Fox went ALL in on STOP THE STEAL.” Fox subsequently promoted Watters and Gutfeld to host eponymous prime-time shows in the network’s weekday lineup. Fox Business anchor Maria Bartiromo, who plugged her show to Trump lawyer Sidney Powell as a “news” platform that would promote her conspiracy theories and urged her to “[p]lease please please overturn” the election, still hosts both of her programs. Think about how incredible our ratings would be if Fox went ALL in on STOP THE STEAL.” · Fox News Host Jesse Watters to Greg Gutfeld, Dec. 5, 2020

Conservative network Newsmax agrees to pay $67M in defamation case over bogus 2020 election claims

The conservative network Newsmax has agreed to pay $67 million to settle a lawsuit accusing it of defaming a voting equipment company by spreading lies about President Donald Trump’s 2020 election loss. DENVER (AP) — The conservative network Newsmax will pay $67 million to settle a lawsuit accusing it of defaming a voting equipment company by spreading lies about President Donald Trump’s 2020 election loss, according to documents filed Monday. The disclosure of the settlement came as Trump, who lost his 2020 reelection bid to Democrat Joe Biden, vowed in a social media post Monday to eliminate mail-in ballots and voting machines such as those supplied by Dominion and other companies. It was unclear how the Republican president could achieve that. The same judge also handled the Dominion-Fox News case and made a similar ruling that the network repeated numerous lies by Trump’s allies about his 2020 loss despite internal communications showing Fox officials knew the claims were bogus.Dominion was at the heart of many of the wild claims aired by guests on Newsmax and elsewhere, who promoted a conspiracy theory involving deceased Venezuelan president Hugo Chavez to rig the machines for Biden. The network retracted some of the more bombastic allegations in December 2020.“How long are we going to play along with election fraud?” Newsmax host Bob Sellers said two days after the 2020 election was called for Biden, according to internal documents revealed as part of the case. Newsmax took pride that it was not calling the election for Biden and, the internal documents show, saw a business opportunity in catering to viewers who believed Trump won. Private communications that surfaced as part of Dominion’s earlier defamation case against Fox News also revealed how the network’s business interests intersected with decisions it made related to coverage of Trump’s 2020 election claims.
